Earlier today Google came out swinging. Seemingly the patient continuously kicked in the face of patent issue, Senior Vice President and Chief Legal Officer David Drummond, Google posted a blog calling out some of the competitors to Google for trying to use "bogus patents to destroy the Android. Chief among competitors, shouted was Microsoft. Drummond said that the software giant has been getting in bed with the other competitors hurt Google.
Among the accusations was that Microsoft has teamed up with Apple to buy old patents, Novell, implying that they did this to keep them from Google.
Microsoft will not take too kindly to that remark.
"Google says we purchased Novell patents to keep them from Google. Right? We asked them to bid jointly with us. They said no, "Brad Smith, General Counsel of Microsoft tweeted out in response.
Features. Just got real shit.
Just in case that wasn't enough, Frank Shaw, head of Microsoft communications, with the real heat. "Free advice for David Drummond – next time check with Kent Walker before you blog. , "Shaw tweeted, referring to another Google Senior Vice President and General Counsel. This Tweet was attached an image by e-mail, send Walker obviously Smith 28 October 2010. It reads as follows:
Brad-
Sorry for the delay in getting back to you — I got off to a 24-hour errors on the way back from San Antonio. After talking with people here, it sounds as though, for various reasons, a joint proposal is not feasible for us on this. But I appreciate your point and we are open for discussion of similar features in the future.
I hope the rest of your trip goes well and I look forward to seeing you again soon.

Although this is only one instance, it really undermine Google the entire argument. Google is trying to create a template Microsoft teaming up with other competitors to Google for their damage. But the first instance was actually the result of Microsoft down, as shown in the Google email. It doesn't look good for Google.
Does this mean totally wrong Google and Microsoft fully right? Of course not. But this of course makes Google look pretty silly. And it reinforces what many observers think about Google position here: that they just weren't to the patent situation too seriously until recently, and now they're all up in arms about it.
God I love it when Google and Microsoft are those fighting in the streets.
